Anyone that has practiced law knows that many times winning gets down to preparation, seeing the justice, creativity in applying the facts and law, and way the attorney communications his case.

·         Preparation. A prepared attorney knows “all” the facts of his case because one fact –omitted or included - can make a great difference between a good argument or a great one – between justice and injustice. So, the first rule to winning in law is to thoroughly marshal the facts – they are your greatest asset or in some cases a liability. But your must know them. Being prepared – knowing all the facts – is crucial to advising the client on the legal arguments, the pros and cons of his case and the chances of winning.

·         Justice. Once you know all the facts, look for the justice under the totality of the circumstances. Once you find the justice you will find the law.

·         Creativity. Two attorneys can take the same case with the same facts and one will win and the other will lose. In fact, I have seen one attorney – one the same day – take different sides of the identical issue in different courts and win in both courts. To a degree, the ability to create strong arguments for either side gets down to creativity. It is about seeing the argument. Seeing the justice.
